Hello All,
I need ur advice.
My H1 expires this sept 19th 2010. I don't have the present H1 stamped.
Also, I have the new extended H1 which is valid from Sept 19th 2010.
Now, I'm planning to travel to India and go for stamping.
1. If I go for stamping before sept19th, on which H1 will i get the visa stamped,present H1 or the new extended H1?
2. Is it safe to go before sept19th or after sept 19th? I prefer the stamping on H1 extension.
I'm flexible with my travel.
I'm waiting to book my appointement based on the advice given.
Appreciate ur inputs!!

gcformeornot is correct. You cannot "transfer" an I-140 approval, but you can keep and use the PD for any subsequent I-140. Once a new LC is approved, a copy of the I-140 approval notice with the 10/2007 PD should be included in the new I-140 submission along with a request to use the old PD on the new I-140 approval notice.

My I-140 cleared on last month, also I applied for 3 year's visa extension, got receipt. Now I want to change company, I got a got offer from a big company. My question is
1. If I'll apply H1-b from new company , how many years visa I'll get(With current I-140)?
2. Is it possible to keep PD of my current GC (Aug'03)? even in case of my current company revoke/use my GC?

On my last exit from USA , I was not carrying original i797 so I gave photocopy of i94, I am returning back to USA now, what shall I do ? Now I have the originals too..

This may have been discussed here before also. But here is my situation-
I am on H1 and have applied for I-140. My wife (on H4) has applied for admissions in a couple of universities. Now, the simple rule is to get F1 visa so that you can do RA/TA during your course. Here are my questions-
1. Will my I-140 will effect her chances of getting F1?
2. How diffcult would it be to get F1 generally? Any tips or suggestions for us?
2. If she applies for F1 (but still she is on H4), can she travel to India? Or will it be too risky to travel then?
3. If she gets F1, do you think it is still risky to travel to India as she will have to get it stamped there? (Coz of my immigration application)

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

Hello,
I am not sure if this is good place to ask this.
1. I have moved out of US 5 months ago and I am working for my GC sponsoring employer overseas. What happens to my I-485? Is it considered abandoned?
2. While I was working as H1 I contributed to 401K. I want to know if I can leave that money in the US till retirement age and then start widrawing while living overseas. I expect I will not be a US citizen at that point.
Can anyone point me to a competent accountant who can help with question 2?

I am having a really emergry question that I need help on.

My Husband was a F1 international student and his F1 service had stopped by his school, but his Visa( China) was expires on July, 2009. Couple months ago, he and I gets married and he is ready for file the green card. But his grandfather is very sick now and he have to go back immedately; however, he didn't file anything at this time. If he having a emergry that need to go back on June , what he can do now? And is he able to come back to US?

My labor is approved, but haven't received approval from immigration yet. Online status is showing it is 'CERTIFIED'. Can I file I-140/485 with just electronic confirmation of labor in case if it get delayed in receiving approval? Bwy does anybody have an idea in how many days immigration will dispatch the approval copy of labor after it is certified?

I am working on H1B visa as full time employee (Business Analyst) for a global manufacturing company. After going throughforums I understand that as consulting employees need client letters, similarly full time employees need in house project documentation for visa stamping. I work in IT department of my company where we maintain applications and provide production support and there is no specific project that I am working on. Should full time employees must have in house project documentation for visa stamping? Will I have any problem if I tell VO that I provide production support and am not working on a specific 1 project?
